At Nockolds Solicitors, we provide a full lease service. This includes:

Commercial Leases

We act on behalf of landlords and tenants on the grant of new commercial leases and short term licences, as well as other transactions during the lease term. This includes lease assignments and sub-letting to new occupiers. Where a new tenant is also taking on an existing business together with the premises, then our Corporate Commercial team can also provide advice on the terms and structure of the business sale. 

Our team regularly advise our clients on the obligations they must comply with under their leases and what rights and responsibilities the other party will be subject to. We advise on heads of terms, break clauses, permitted use and repair covenants. Our lease services also include documents ancillary to the lease, such as agreements for lease, rent deposit deeds and licences for alterations.

If the lease requires amendments during the lease term, we also assist with deeds of variation to document this. When the lease reaches the end of its term, we help our clients in closing any leasehold titles with the Land Registry and/or documenting the end of the lease in a deed of surrender, if required.

We also have experience with lease renewals between existing landlords and tenants, including renewals under the Landlord and Tenant Act 1954 Act. If a lease is protected under the Landlord and Tenant Act 1954, we work together with our Disputes Team in preparing and serving the requisite statutory notices.

Leasehold Property and Investment

Whether you are an investor or looking to acquire premises for trade purposes, we can assist on a wide range of leasehold property, including retail, airspace, industrial units and offices.

We have experience in acting for charities and pension funds in relation to leasehold property. This involves working together with trustees and agents to ensure the property meets any requirements.

We can also assist you with any finance which may need to be raised to fund the acquisition and regularly act for both borrowers and lenders in connection with this.
