Some Other Substantial Reason – Dismissal

Some other substantial reason is the fifth potentially fair reason for dismissing an employee with protection from unfair dismissal and acts as a catch all for any issues which arise that would justify dismissal but which do not fit within any of the other four potentially fair grounds.

Examples can very widely but typically concentrate on the break down in working relationships with colleagues or customers, a dismissal necessary to help protect the business and retirement.

As with all dismissals it is vital that you follow a fair process but unlike most other dismissals there is no set process that would need to be followed as the situations covered by some other substantial reason are so varied.  Typically though it would involve meeting with the employee to discuss the reason and seeing if there was any alternative, for example another role, a mediation with the colleagues concerned or some other accommodation that can be reached.
