Employment Tribunal Waiting Times Update

In response to a written question in Parliament the Ministry of Justice has released data confirming that the average time from receipt of an Employment Tribunal Claim to a first hearing is 335 days for claims made by a single employee. This first hearing might be a preliminary hearing and does not mean that the case has been completed and Judgment issued.

The data confirms that there continue to be extensive delays in the processing of Employment Tribunal Claims. Before the pandemic the Tribunals aimed to complete all cases within an average of around 40 weeks and did often achieve that. The huge number of Claims issued as a result of the changes in the economy cause by the pandemic has caused a very significant backlog with significant numbers of cases now listed for 2023.
