Anyone who has bought or sold a home in England and Wales will know just how stressful the process can be.
One of the biggest frustrations is gazumping: you make an offer on a house or flat, it is accepted, and then another buyer comes along with a higher offer before contracts have been exchanged.
At the moment, an accepted offer is not legally binding. Either party can walk away before exchange of contracts, often after weeks or months of time, legal work and expense.
That may now be set to change.
The Government’s proposed reforms aim to make the homebuying process faster, fairer and more secure by introducing:
- Upfront sales packs, so buyers have key information before making an offer;
- Earlier binding agreements, to reduce the risk of parties walking away without a legitimate reason;
- More digital tools, to cut delays and unnecessary duplication; and
- Higher standards for estate agents through a new Code of Practice and potential mandatory qualifications.
The Government has said the changes could reduce buying times and save hundreds in costs.
From a conveyancing perspective, I find this really interesting.
When I first started practising residential property law over 20 years ago, Home Information Packs, or HIPs as we fondly called them, were introduced. They were not perfect, and perhaps the market was not quite ready for that level of upfront information at the time.
But the principle was not wrong.
Buyers should be able to make informed decisions at the outset, not halfway through a transaction when they have already incurred costs and invested emotionally in the purchase.
If these proposals are implemented well, they could make a real difference to the number of transactions that fall through and bring some much-needed certainty to the process.
Of course, the detail will matter. There are fair questions about how quickly properties can come to market if more paperwork is required upfront, and how these agreements will work in practice. I am sure in the world of AI all well know legal search companies will be falling over themselves to prepare these sales packs.
However, in my view, this feels like a long overdue step towards bringing the conveyancing process into the 21st century.
