Many Spanish citizens come to the UK for work purposes. Many of them will need a certificate to confirm whether or not they have any criminal record. The official translation into English of the certificate has to be submitted as well. Equally British citizens living in Spain may need to submit a Criminal Record Certificate and its official translation in Spanish.
There are important differences between the certificate in Spanish and the certificate in English.
In Spain, the Criminal Record Certificate is issued by the Ministry of Justice.
In accordance with the Council Framework Decision 2009/315/JHA this certificate will include the convictions handed down by other Member States of the European Union.
The convictions handed down in other Member States may not be considered equal to the national convictions.
The English certificate is a “police certificate” issued by the ACRO Criminal Records Office for immigration purposes. This “police certificate” confirms more personal information than the Spanish certificate. For example, it states the date and place of birth and the address of the holder. However, it does not make any specific reference to the Decision and the convictions handed over by other Member States.
Official translations into Spanish of the ACRO certificates are required as part of the Visa application for Spain.

Spanish official translators are also authorised to do official translations of criminal records or police certificates issued in English from any other speaking country such as USA, Australia, Canada, The Philippines.

Muchos ciudadanos españoles trabajan en el Reino Unido. En muchas ocasiones, necesitarán presentar un certificado que confirme si tienen antecedentes penales o no. También se tendrá que presentar la traducción jurada al inglés. De igual manera, los ciudadanos británicos que vivan en España pueden verse en la necesidad de presentar un certificado de penales y su traducción jurada al español.
Hay importantes diferencias entre el certificado en español y el certificado en inglés.
En España, el Certificado de Penales le emite el Ministerio de Justicia.
De conformidad con la Decisión Marco 2009/315/JAI, el certificado incluirá los delitos en otros Miembros Estados. Los tipos de delitos pueden variar de un Estado Miembro a otro.
El certificado de penales en inglés es un “certificado policial” emitido por los Altos Mandos de la Policía y ACRO Criminal Records Office que sería el equivalente del Registro Central de Penados. Este “certificado policial”, para los fines de inmigración, confirma más información personal que el certificado español. Por ejemplo, indica la fecha y lugar de nacimiento y la dirección del titular. Sin embargo, no hace ninguna referencia específica a la directiva y los delitos en otros Miembros Estados.
Las traducciones juradas al español de los certificados policiales ACRO son necesarias como parte de la solicitud del Visado para España.
Los traductores jurados son expertos en Derecho Comparado y en las diferencias entre los sistemas jurídicos, por lo tanto, producirán traducciones precisas para que las Autoridades españoles o británicas acepten las traducciones.
Los traductores jurados españoles están autorizados a hacer traducciones juradas de antecedentes penales o certificados policiales emitidos en inglés de cualquier país angloparlante como, por ejemplo, Estados Unidos, Australia, Canadá, Filipinas.
