Divorce is often quoted as one of life’s most stressful events, but can you have a good divorce?
With the introduction of joint divorce applications in April 2022 this was step towards more amicable applications especially where parties were in agreement that their relationship had irretrievably broken down. There still does remain a perception that once a party obtains legal advice, especially where the other party has not yet taken that step, that this is an adversarial move and will inevitably lead to costly litigation.
There are cases where court hearings are necessary, but divorce and the division of the matrimonial assets does not have to automatically be a matter of high conflict. The idea of Good Divorce week is to highlight the work of Resolution and dispel the stereotypical view that divorces are always bitter and end up in court. Resolution is an organisation made up of more than 6,500 family justice professionals and has a Code of Practice which sets out the principles of a non-confrontational approach to family matters to which members commit. The hope being that by trying to avoid inflaming matters and by not making unnecessary applications that this will enable parties to have a better chance of reaching a swift resolution. The Code is also practical in setting out how Resolution members work with their peers, colleagues and clients to reduce tension and include:
- Avoiding inflammatory language;
- Supporting and encouraging families to put the best interests of children first;
- Acting with honesty, integrity and objectivity;
- Helping clients consider the long-term emotional and financial impact of their decisions;
- promoting communication and collaboration wherever possible; and
- Using experience and knowledge to guide clients through the options available to them.
