No Fault Divorce from 6 April 2022

The Government announced in response to a Parliamentary question that no fault divorce will come into force on 6 April 2022.

The change will come from the Divorce, Dissolution and Separation Act 2020 which will allow couples to divorce without assigning blame. Under the current legislation, couples who have not been separated for more than 2 years must blame the other for the breakdown of the relationship, either through the other’s adultery or behaviour.

This announcement represents a momentous change to divorce legislation and will be a welcome relief to clients and professionals alike.
