Saagar joined Nockolds in September 2019 and is an Associate in our Commercial and Property Litigation Team. Saagar is based in London but works across both our London and Bishop’s Stortford offices and has a busy practice in both our Commercial Litigation and Property Litigation practices.
Saagar deals with a wide variety of property disputes including boundary disputes, claims of trespass and disputed rights of way. Saagar also has a particular niche with landlord and tenant disputes, including rent recovery, forfeiture and claims for possession, dealing with both commercial and residential property matters. He is a member of the Property Litigation Association.
He also deals with a broad spectrum of commercial disputes, in bringing and defending claims for, breach of contract, negligence, and misrepresentation. Saagar has a particular focus in debt recovery, contractual disputes and consumer matters.
Regardless of the type of dispute you may be facing, Saagar is well equipped to gauge the situation and provide commercial and practical advice to his clients, to keep matters cost and resolution effective. Clients have particularly appreciated Saagar’s straightforward and commercial manner, which has allowed for a range of disputes to be settled or otherwise brought to an appropriate close by the measured advice provided.
Saagar is excellent at fostering valuable relationships with his clients, and other professionals, to provide a seamless and rounded service. This has allowed him to negotiate effective settlements avoiding the issuing of proceedings, a quality that many clients value in the current economic times. He also has a keen eye and skill for identifying key relationships to build and maintain, and as a result, often receives continual referrals from clients, agents and other third parties.
Saagar works closely with other Teams at Nockolds, especially our Corporate & Commercial, Commercial Property and Residential Property teams, which enables clients to have a fully rounded service.
Saagar is a co-founder of Neeti: Young Lawyers’ Association (UK) and a member of the Hindu Lawyers’ Association (HLA UK). He is also the Vice President of Shree Jain Sangh East London & Essex, a charity promoting the tenets of Jainism.
Saagar is heavily involved in the firm’s Equality, Diversity and Inclusion Team and has a passion for supporting and promoting diversity in the legal sector.
Recent Experience
Property Litigation
- Routinely advises and deals with all aspects of residential possessions. One case in particular, involved unlawful subletting via AirBnB in which Saagar successfully obtained a possession order.
- Successfully dealt with an appeal regarding a 1954 Act business lease renewal claim whereby the Judge had determined the rent, term and other terms of the lease at the preliminary hearing without any evidence.
- He repeatedly deals with forfeiture by peaceable re-entry for commercial premises ensuring compliance with legislation and a successful outcome for landlords.
- Successfully obtained a forfeiture order in respect of mixed-use premises, and a costs order on the indemnity basis.
- Routinely advises landlords regarding dilapidations on the Dilapidations Protocol, laying foundations for a successful claim, most of which have been capable of settlement at an early stage. Working alongside key surveyors this allows a seamless experience to be provided to clients.
- Dealt with a long running dispute with a Housing Association regarding their general management of the Estate and obtained a satisfactory result for the client.
Commercial Litigation
- On multiple occasions has obtained favourable costs orders in the small claims court which is very rare, and on an occasion obtained a 100% cost order.
- Has successfully handled a debt recovery claim, which has proceeded with enforcement action by way of a suspended Attachment from Earnings Order against the debtors, ensuring timely and regular payments.
- Obtained a favourable determination from the Energy Ombudsman in respect of significant overcharging of tariffs to a commercial client.
- Has repeatedly obtained payments for his clients from their debtors by having detailed knowledge of the debt recovery and insolvency processes and how these can be used to achieve the desired outcome.
- Successfully and swiftly settled a prospective claim for alleged data breach, allowing the client to manage its reputation and risk accordingly.
- Dealt with a range of vehicle consumer disputes, ensuring the provisions of the Consumer Rights Act 2015 are upheld.
- Successfully dealt with insurance payout following the total loss of a vehicle, and a refusal from the insurer to payout to the client.
