An Employment Tribunal has delivered its judgement in the case of a group of nurses who complained about a transgender colleague’s use of a female changing room.
The Tribunal found that County Durham and Darlington NHS Foundation Trust unlawfully discriminated against and harassed the Darlington Nurses by requiring them to share female-only changing rooms with their transgender colleague. The Tribunal held that the policy and the failure to consider and address the nurses concerns had the effect of violating their dignity and creating a hostile, intimidating, humiliating and degrading environment for them.
This ruling follows the Supreme Court judgement where it was decided that a woman means a biological woman. It underlines the urgent need for clear, authoritative guidance for employers who will need to consider how single sex facilities or services might operate in light of the recent judgements.
