The government is seeking views on proposed changes to leaseholders’ rights in England and Wales, focussed on access to gigabyte-capable broadband in flats.
The consultation looks at new legislation designed to support the rollout of high-speed broadband, building on the existing Electronic Communications Code.
The proposals include:
- Giving leaseholders the right to request the installation of a gigabyte-capable broadband connection.
- Placing a duty on freeholders not to unreasonably refuse such requests. This duty would apply broadly, regardless of ownership structure, building management arrangements, or lease terms.
- Requiring freeholders to respond to requests within set timeframes, so applications are handled promptly.
- Introducing an enforcement mechanism to ensure the rules are followed.
The consultation is open until 16 February 2026.
