“Pay now, argue later”, adjudication is an alternative method of resolving disputes, and is particularly unique to the construction industry. The Construction Act 1996 gives parties in a construction project the ability to call in an adjudicator to govern and resolve a dispute on a particular matter.
The advantages are that it is:
- Cheaper than going to court or going through arbitration
- The decision can be made in as little as 28 days meaning it can be resolved quite quickly
- Your business benefits from cash flow still coming in
- Your business avoids expensive legal costs
The adjudicator’s decision is a binding commitment on both parties so once the decision is made, you have no choice but to follow it. This could be seen as a disadvantage, but inevitably the benefits of avoiding court will always be a consideration for a business faced with pursuing a matter any further.
