International Dismissal and Coercion
The client was employed by a company based abroad. Having been with the company for several years the employee was issued with the ultimatum to accept an agreed termination or otherwise be dismissed. Having signed the agreement agreeing to the termination without legal advice, his employment was terminated. On recommendation from an existing client, the client sought the advice of Darren Hayward. The case was complicated in that there were cross-jurisdictional issues and the right of the client to bring Employment Tribunal proceedings in the UK, the fundamental issues were whether this was a “dismissal” in law and whether there was coercion.
