The NHS has a legal obligation to fund the costs of care when a person has what is known as a “primary health need”. Over the last few years we have experienced an increase in the number of cases where the NHS has wrongly refused to fund care fees. When a loved one is not well and requires care, it is understandable that the cost of the care and who should pay is not the primary concern, and often families do not realise that fees have been mistakenly charged and paid until several years after the person being cared for has passed away.
