Family & Matrimonial
- The Domestic Violence, Crime and Victims Act 2004 in force on 1st July means a breach of a non-molestation order is now a criminal offence punishable by up to 5 years imprisonment.
- Denise Rowley loses her case in the Court of Appeal against the Child Support Agency…She failed in her attempt to argue that the CSA owed her a duty of care …. Her view was that the agency has been negligent in failing to collect payments for child support on behalf of her children.
- Cohabitation - ‘Legal Rights Bill’ debate heats up... The long awaited report from the Law Commission who are considering proposals to give cohabitants legal rights similar to those of married couples, is expected to be published late July 2007.
- Pre–nuptial agreements - Make them, recommends the President of the Family Division …. In light of the decision in the case of Chairman, Sir Mark Potter also called for the reform of ancillary relief laws as English divorce law is seen as outdated and unfair compared to the rest of the European states.
