COMPULSORY FAMILY MEDIATION
With effect from 06 April 2011 parties seeking a Court Order in relation to children or financial remedies (with limited exceptions including enforcement or protection of a child or financial assets) will be required to attend a Mediation Information and Assessment Meeting (MIAM) with a suitably qualified Mediator before issuing an application at Court to consider with a Mediator whether their dispute may be capable of being resolved through mediation.
This change in the rules is to raise public awareness of the benefits of mediation as a form of dispute resolution. Parties are not being forced to mediate they are simply being required to attend an Information Meeting to find out whether or not mediation could assist them as a means of resolving their disputes.
